1. Acceptance of Terms

By accessing or using the UstayUpay website and services ("Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

UstayUpay provides an online document preparation platform that assists Florida landlords, property managers, and process servers in generating eviction notices and court-filing documents. The Service generates documents based on information you provide. We do not review, verify, or guarantee the accuracy of the information you enter, nor do we guarantee that the documents generated will be accepted by any court or governmental body.

3. Not Legal Advice

The Service, its content, and any documents generated are provided for informational and document preparation purposes only. Nothing on the UstayUpay platform constitutes legal advice, and no attorney-client relationship is formed by your use of the Service. Laws and regulations governing landlord-tenant relationships and eviction procedures may change. You are solely responsible for verifying that any documents generated comply with current applicable laws.

4. Accounts and Registration

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately at support@ustayupay.com of any unauthorized use of your account
• Be responsible for all activity that occurs under your account

We reserve the right to terminate accounts, remove content, or cancel subscriptions at our discretion.

5. Subscription Plans and Billing

UstayUpay offers paid subscription plans billed on a monthly or annual basis. By subscribing to a paid plan:

• You authorize us to charge your payment method on a recurring basis until you cancel
• Subscription fees are billed in advance at the start of each billing period
• All subscriptions include a 30-day free trial for new accounts; no charges are made during the trial period
• You may cancel your subscription at any time through your account portal or by contacting support
• Cancellations take effect at the end of the current billing period; no partial refunds are issued for unused time
• We reserve the right to change pricing with 30 days' notice to your registered email address

Payments are processed by Stripe. By providing payment information, you agree to Stripe's terms of service. UstayUpay does not store your full credit card information.

6. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service for any purpose that is unlawful or prohibited by these Terms
• Generate documents containing false, fraudulent, or misleading information
• Attempt to gain unauthorized access to any portion of the Service
• Use automated tools to scrape, crawl, or extract data from the Service
• Resell, sublicense, or otherwise transfer access to the Service without written permission
• Upload or transmit viruses or any other malicious code

7. Accuracy of Documents

While we make every effort to ensure the documents generated by the Service reflect current Florida law, we make no warranty or guarantee that any document is legally sufficient, court-approved, or appropriate for your specific situation. Court requirements vary by county and may change. You are solely responsible for reviewing all generated documents before use and for ensuring they comply with the requirements of your local court.

8. Intellectual Property

The Service and its original content, features, and functionality are owned by UstayUpay and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our written permission.

Documents you generate using information you provide are yours to use for their intended purpose. You retain ownership of the data you input into the Service.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated by reference into these Terms. Please review the Privacy Policy to understand our practices.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, USTAYUPAY DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy or completeness of any content or documents generated.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, USTAYUPAY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability to you for any claims arising from your use of the Service shall not exceed the total amount paid by you to UstayUpay in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless UstayUpay and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

13. Modifications to the Service and Terms

We reserve the right to modify or discontinue the Service at any time without notice. We may revise these Terms from time to time. We will notify you of material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Florida.
